TITLE VI COMPLAINT INSTRUCTIONS AND PROCEDURE

Any person who believes she or he has been discriminated against on the basis of race, color, or national origin by Fayette Area Coordinated Transportation (FACT) may file a Title VI complaint by completing and submitting FACT’s Title VI Complaint Form. FACT investigates all completed complaint forms that are filed no later than 180 calendar days following the date of the incident in question.
How to file a complaint:
- A complaint can be filed in writing and mailed to the following address:

- The preferred method is to file a complaint in writing by completing FACT’s Title VI Complaint Form. A complaint form can be downloaded from FACT’s website: https://www.factbus.com/Title_VI.htm#attachments or by contacting FACT at 724-628-7433.
- If you do not use FACT’s Title VI Complaint Form, your written complaint must be signed and, at a minimum, must contain the following:
- Contact information, including name, mailing address, telephone number(s), and e-mail address, etc.
- A description of how, when, where, and why you believe you were discriminated against, including location, names, and contact information of any witnesses.
- Other information that you deem significant or important.
- A complaint can be filed verbally by calling FACT’s Title VI Coordinator, at (724) 628-7433. .
- You also have the right to file a complaint with an external entity, such as the Department of Transportation (DOT), a federal or state agency, or a federal or state court. Below is the address for the Federal Transit Administration:

Title VI Procedure:
- When a complaint is received by FACT, the Title VI Coordinator will investigate the complaint and within ten (10) calendar days after receipt of a completed complaint, a determination/resolution letter or e-mail will be sent to the complainant. In some situations, additional time may be needed to resolve a complaint and as such, the determination letter will indicate the additional time needed to investigate the complaint. The complainant will be advised of the need for additional time. The additional time will not exceed thirty (30) calendar days from receipt of the complaint. The parties may extend any time limit by written agreement.
If a complaint is incomplete, additional information will be requested, and the complainant will be provided thirty (30) business days to submit the required information. If the information is not received within thirty (30) business days, the case can be administratively closed by FACT. A case can also be administratively closed if the complainant no longer wishes to pursue their case.
- Should a complaint be filed with FACT and an external entity simultaneously, the external complaint shall supersede FACT’s complaint and FACT’s complaint procedures will be suspended pending the external entity’s findings.
- The complainant can appeal the determination/resolution within thirty (30) calendar days of receipt of FACT's response to the complaint. An appeal can be made in writing, telephone or in person to FACT's Executive Director. Complainant will need to identify the reason for the appeal and provide any supporting documentation. FACT will respond in writing within ten (10) calendar days from date appeal was received.
FACT documents, maintains and tracks complaints. The fiscal department maintains files and records relating to complaints for a period of five (5) years. |
